This Privacy Statement/Policy explains the collection, use, protection, disclosure, sharing and transfer, if any, of “PII” by Aarca. We reserve the right to amend this Privacy Policy from time to time based on changes as per the business, legal and regulatory requirements and applicable laws and the same shall be updated on this website.

DEFINITIONS: As used in this Policy, the terms listed below have the following meanings:

Customer — A “Customer” is anyone who uses Aarca products or services. When a Customer purchases retail products or services for use by others, those individuals also may be considered Customers for purposes of this Policy.

User — A “User” is anyone who visits our websites.

Personally identifiable information (hereinafter referred to as PII): “Personally Identifiable Information” is information that is about, or can be related to, an identifiable individual. It includes any information that can be linked to an already identified individual or used to directly or indirectly identify an individual. Personal information does not include information that is anonymous, aggregated, or is no longer identifiable to a specific person.

Sensitive PII (Hereinafter referred to as SPII): “Sensitive PII” means PII which is more sensitive in nature viz. financial information such as Bank account or credit card or debit card or other payment instrument details, Biometric details, passwords or authentication information for any of our products or services etc. For the purposes of this Privacy Statement, sensitive PII has been considered as a part of PII. This Privacy Statement describes the Personal Information which we may collect and our approach towards handling or dealing with the same.

This Privacy Statement is designed to enable you understand:

Aggregate Information — “Aggregate Information” means information about groups or categories of Customers or Users, which does not identify and cannot reasonably be used to identify an individual Customer or User. Aggregate Information is a kind of Anonymous Information.

Website — “Website” means any page or location on the Internet, no matter what device (cell phone, lap top, PC, etc.) or protocol (http, WAP, ftp or other) is used to access the page or location. In this Policy, we use the term website other similar terms such as “Internet site,” “site,” and “web page.”

Introduction

  1. This is a notice to inform you of our policy about all personal identifiable information that we record about you. It sets out what information we collect from you and the conditions under which we may process any information that we collect from you, or that you provide to us. It covers information that could identify you (“PII”) and information that could not. In the context of the law and this notice, “process” means collect, store, transfer, use or otherwise act on information.

The basis on which we process information about you

  1. Information we process because we have a contractual obligation with you
  2. When you are receiving service from us or have received some services earlier from us, or otherwise agree to our terms and conditions, a contract is formed between you and us.

    In order to carry out our obligations under that contract we must process the information you give us. Some of this information may be personal information.

    We may use it in order to:

    Our goal of collecting your PII is to provide you with the best customer experience possible by communicating with you regarding service updates, offers and promotions; delivering advertising that may be of interest to you (unless you have asked us to not contact you); addressing network and security issues; investigating or taking action regarding illegal activities or violations of our Terms of Use or other policies, as may be laid out in our website from time to time. We collect some PII on an anonymous basis and may anonymize the PII we collect about you into data groups. When we employ non-Aarca companies to anonymize or aggregate data on our behalf, the requirements for sharing PII with non-companies apply. We may share aggregate or anonymous information in various formats with trusted non-Aarca entities, with whom we have contracted with to aggregate such data and may work with those entities to do research and provide products and services. When Aarca jointly provides a service with a non-Aarca company, your Personal Information may be subject to both this Policy and the privacy policy of the non Aarca Company. We encourage you to review the privacy policies of any non-Aarca Company with which we do business to determine what information will be collected and how it will be used or disclosed to others.

    We also collect your PII to:

    • Verify your identity as mandated by laws and regulations;
    • Process your orders and applications;
    • Data Analytics that help us get valuable insights to enhance customer experience as well as improve upon service delivery.
    • Provide the relevant service or product to you, which includes other services not included in your agreement with us and services that use information about location tracker, and to contact you with service-related messages about changes to the service or product;
    • Administer your account and bill you for using our products or services rendered to you;
    • Respond to any questions or concerns that you may have about using our network, products or services;
    • Understand how our different customers use our network, products and services so we can develop more interesting and relevant products and services for our customers, as well as personalize the products and services we offer you;
    • Carry out research and statistical analysis and monitor customer use of our network, products and services on an anonymous or personalized basis;
    • Settling accounts with those who provide related services to us;
    • Carry out any activity in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, crime or fraud prevention, detection or prosecution;
    • Carry out activities connected with the running of our business such as personnel training, quality control, network monitoring, testing and maintenance of computer and other systems and in connection with the transfer of any part of our business in respect of which you are a customer or a potential customer;
    • Other usages that you may consent to;

    Wherever possible, we aim to obtain your explicit consent to process this PII, for example, by asking you to agree to our use of cookies.

    Sometimes you might give your consent implicitly, such as when you send us a message by e-mail to which you would reasonably expect us to reply.

    Except where you have consented to our use of your information, we do not use your information in any way that would identify you personally.

    If you have given us explicit permission to do so, we may pass your name and contact information to selected third parties whom are engaged with us to provide you services as normal.

    We will disclose the subcontractors we will use for processing your PII and also we will take your consent before changing a subcontractor or engaging a new subcontractor for processing your PII.

    We continue to process your information until you withdraw your consent.

    You may withdraw your consent at any time by instructing us contact@aarcaresearch.com. However, if you do so, you may not be able to use our website or our services as normal.

  5. Information we process for the purposes of legitimate interests
  6. We may process PII on the basis there is a legitimate interest, either to you or to us, of doing so.

    Where we process your information on this basis, we do after having given careful consideration to:

    • whether the same objective could be achieved through other means
    • whether processing (or not processing) might cause you harm
    • whether you would expect us to process your data, and whether you would, in the round, consider it reasonable to do so

    For example, we may process your PII on this basis for the purposes of:

  7. Information we process because we have a legal obligation
  8. We are subject to the law like everyone else. Sometimes, we must process your information in order to comply with a statutory obligation.

    For example, we may be required to give information to legal authorities if they so request or if they have the proper authorisation.

    This may include your PII.

We do not sell your PII to anyone for any purpose, and we maintain information about you in our business records while you are a customer, or until it is no longer needed for business, tax, or legal purposes.     We will adopt a 'need-to-know' principle and make reasonable efforts to ensure that access to PII is given only to those who need it to conduct their official and legitimate duties. We share your PII only with non-Aarca companies that perform services on our behalf, and only as necessary for them to perform those services. We require those non-Aarca companies to protect any PII they may receive in a manner consistent with this policy, and we do not provide PII to non-Aarca companies for the marketing of their own products and services without your consent. We may provide PII to non-Aarca companies or other third parties for purposes such as emergencies, pursuant to court orders, identity verification to prevent fraud and identity theft, enforcing of property rights, or obtaining payment for products and services that appear on your Aarca billing statements.

    If you use the services provided by another company to interact with us, such as a virtual assistant or a social media platform, please be aware that your data is also subject to the privacy policies of these companies. You may withdraw your consent to process your data with a third party at any time by instructing us via contact@aarcaresearch.com. However, if you do so, you may not be able to use our website or our services as normal.

  11. Who has access to data we collect
  12. We process and access the data we collect from you. However, we use third parties to assist us with processing your PII including the following categories of recipients:

    • Financial transaction processors (processing your payments)
    • Customer service communication platform
    • Email communication manager
    • Website management services
    • Website design and programming services
    • Users / Sub-Contractors / Contractors to the extent necessary for our business objectives.

    These third parties have a contract with us, wherein, they are prohibited from utilizing, sharing or retaining your PII for any purpose other than we dictate.

  14. Our website includes Social Media Features, such as the Facebook, YouTube, LinkedIn or Twitter button. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the third party company providing them.

Aarca will use this PII in accordance with the purpose set forth in this Privacy Notice and is committed to safeguarding the PII collected.

We have established electronic and administrative safeguards designed to secure the information we collect, to prevent unauthorized access to or disclosure of that information and to ensure it is used appropriately. Although we strive to keep your PII secure, no security measures are absolute, and we cannot guarantee that your PII will never be disclosed in a manner inconsistent with this Policy. We will make reasonable attempts to notify you if we determine that Aarca has experienced a security breach and there is a reasonably likely risk of identity theft, or where otherwise required by law.

    Some measures we have in place to protect your PII are:

    • To prevent unauthorized access, maintain PII accuracy, and ensure the correct use of PII, we apply physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of PII stored on our system;
    • We protect the security of your information while it is being transmitted by encrypting it;
    • We use computer safeguards such as firewalls and data encryption to keep this data safe;
    • We only authorise access to employees and trusted partners who need it to carry out their responsibilities;
    • We regularly monitor our systems for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security;

    • We will reveal only the last four digits of your payment card number when confirming an order

Aarca urges you to acquaint yourself with the terms and conditions and privacy policy of every such Third Party Website and in this regard, Aarca hereby expressly disclaims all liabilities with respect to the manner in which the Third Party Website collects and/or uses the Information. Aarca may enter into written product or service agreements with business customers that contain specific provisions related to the confidentiality, security or other handling of information. When provisions of a written product or service agreement differ from or conflict with the provisions of this Policy, the terms of the written agreement will apply. In all other instances, the terms of this Policy apply.

    Your Rights & Access to your own information

  31. Access to your PII

    • To obtain a copy of any information that is not provided on our website you may send us a request at contact@aarcaresearch.com.
    • After receiving the request, we will tell you when we expect to provide you with the information, and whether we require any fee for providing it to you.

  37. Aarca works hard to detect and prevent junk e-mails (also referred to as “spam” e-mails) from ever reaching your computer. However, if you are receiving unwanted spam from a Aarca e-mail address, please contact us for assistance at contact@aarcaresearch.com.

  38. Account Set-Up
  39. When selecting Usernames and passwords for Aarca accounts, you should choose words or characters that are not obvious. Likewise, you should always keep PII such as account numbers, Usernames, passwords or similar information in a secure place and not share the them with others

  40. Use of site by children
    • We do not provide services for purchase by children, nor do we market to children.
    • If you are under 18, you may use our website only with consent from a parent or guardian
    • We collect data about all users of and visitors to these areas regardless of age, and we anticipate that some of those users and visitors will be children.
    • Such child users and visitors will inevitably visit other parts of the site and will be subject to whatever on-site marketing they find, wherever they visit.

Information about our Customers and Users, including PII, may be transferred as part of any merger, acquisition, sale of company assets, or transition of service to another provider, as well as in the unlikely event of an insolvency, bankruptcy, or receivership in which Customer and User records would be transferred to another entity as a result of such a proceeding, you acknowledge and agree that the Information may form part of the transferred assets. You further acknowledge that the acquirer or successor of Aarca may continue to use the Information in the manner set forth herein, provided that Aarca shall make reasonable commercial efforts to ensure that the acquirer or successor keeps the Information that they may receive from Aarca confidential as per industry standards.
